• Payment processors: GCash (GXI), Maya (PayMaya Philippines), BPI, BDO, Metrobank, GrabPay, and other licensed Philippine payment institutions — solely to process your transactions;

• Cloud infrastructure and hosting providers: Engaged to host and operate arinalive.ph's platform infrastructure — these providers process data only to provide infrastructure services and may not use your data for their own purposes;
• Customer support platform providers: Engaged to operate arinalive.ph's live chat and ticketing systems;
• Fraud detection and AML compliance tools: Automated risk-assessment services that process certain transaction and behavioral data to detect suspicious activity.

6.2 Regulatory and Legal Disclosure

arinalive.ph may disclose personal data to PAGCOR, the AMLC, the NPC, the Bureau of Internal Revenue (BIR), or other Philippine government bodies, courts, or law enforcement agencies where required to do so by law, court order, or regulatory directive. 6.3 Business Transfers

In the event of a personal data breach that is likely to give rise to a real risk of serious harm to the affected data subjects, arinalive.ph will notify the NPC within 72 hours of becoming aware of the breach, and will notify affected data subjects without undue delay, as required by the DPA and NPC Circular 16-03.

9. Data Retention

arinalive.ph retains personal data only for as long as necessary to fulfil the purpose for which it was collected, subject to the following minimum retention periods that apply by virtue of Philippine legal requirements:

• Account and identity data: Retained for the duration of your active account plus a minimum of five (5) years following account closure, in compliance with PAGCOR record-keeping requirements and AMLA obligations (RA 9160 requires retention of covered and suspicious transaction records for at least five years);
• Transaction records: Retained for a minimum of ten (10) years in compliance with BIR record-keeping requirements applicable to gaming operators under the National Internal Revenue Code;
• Customer support records: Retained for three (3) years following resolution of the relevant support interaction;
• Marketing communication preferences and consent records: Retained for the duration of the relevant marketing relationship plus one (1) year to allow for regulatory audit;
• Technical and session logs: Retained for a maximum of twelve (12) months from the date of creation, unless a specific log is required to be retained for a longer period in connection with an active investigation or dispute.

Upon expiry of the applicable retention period, personal data is securely deleted or anonymized in a manner that prevents re-identification. Anonymized data (data from which all identifying information has been irreversibly removed) is not subject to the DPA and may be retained and used by arinalive.ph for statistical analysis indefinitely.

10. Children and Minors Under 21

arinalive.ph's platform is strictly for adults who are at least 21 years of age, as required by PAGCOR for all real-money gambling activities in the Philippines. arinalive.ph does not knowingly collect personal data from persons under 21.

Where arinalive.ph identifies — or is notified — that personal data has been submitted by a person under 21, the relevant account will be suspended immediately, the personal data will be deleted or anonymized, and any deposited funds will be returned (net of any applicable processing fees) following verification of identity. If you believe a minor has registered on arinalive.ph using false age information, please contact our Data Protection Officer immediately using the contact details in Section 14.

11. Your Rights as a Data Subject

Under the Philippine Data Privacy Act of 2012, you have the following rights in relation to your personal data held by arinalive.ph. To exercise any of these rights, contact arinalive.ph's Data Protection Officer as described in Section 14. arinalive.ph will respond to rights requests within thirty (30) days of receipt.

12. Cross-Border Data Transfers

arinalive.ph's primary operations and data storage are based in the Philippines. Where the use of third-party service providers (such as cloud infrastructure providers or KYC verification platforms) involves the transfer of personal data outside the Philippines, arinalive.ph ensures that such transfers are subject to appropriate safeguards in compliance with Section 21 of the DPA and NPC Circular 16-01, including:

• Data processing agreements that impose DPA-equivalent data protection standards on the receiving party;
• Transfer to countries or organizations that have been recognized by the NPC as providing adequate levels of data protection; or
• Binding corporate rules or equivalent contractual protections where the receiving entity is part of the same corporate group as arinalive.ph.

arinalive.ph will not transfer your personal data to any jurisdiction or entity that does not provide appropriate protections equivalent to those required under Philippine law.

13. Amendments to This Privacy Policy

arinalive.ph may update this Privacy Policy from time to time to reflect changes in the platform, applicable law, or regulatory guidance issued by the NPC or PAGCOR. The date of the most recent update is displayed at the top of this document.

Where an amendment materially changes how arinalive.ph processes your personal data or materially affects your rights under this Policy, arinalive.ph will notify registered users via the email address associated with their account at least fourteen (14) days before the amendment takes effect, and will post a prominent notice on the platform.

Continued use of arinalive.ph following the effective date of an amendment constitutes your acknowledgment of the updated Policy. Where an amendment requires fresh consent under the DPA, arinalive.ph will obtain that consent separately before processing begins under the amended basis.
